§ 91.01. DEFINITIONS.

  • For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
    ALCOHOLIC BEVERAGE. Has the same meaning as set forth in I.C. 7.1-1-3-5, or a liquid or solid that is, or contains, 0.5% or more alcohol by volume; is fit for human consumption; and is reasonable likely, or intended, to be used as a beverage.
    CAR. A motor vehicle, that, in common usage, is referred to as a CAR. Common elements of a CAR include 4 tires, front and back seats that do not provide room for standing and the names "sedans" and "convertibles."
    CONTAINER. Has the same meaning as set forth in I.C. 7.1-1-3-13, or a receptacle in which an alcoholic beverage is immediately contained and with which the alcoholic beverage contained in it is in immediate contact.
    IMMEDIATE AREA. For vans, shall be defined as the interior area of the van, which is located behind the area farthest to the back of the van where a seat can be affixed, regardless if the seat is, in fact, affixed. For station wagons and other cars without trunks, shall be defined as the total area of the interior of the car, except the area to the rear of the seat which is located the farthest to the back. For cars with trunks, shall be defined as the total interior area of the car. For recreational vehicles, shall be defined as the interior area encompassing the front seats. This area includes the area between the driver's and front passenger doors, the glove compartment, dashboard, interior windshield area and any cavities in the driver's door and front passenger door. For all other types of motor vehicles including all types of trucks, shall be defined as the total interior of the motor vehicle.
    MOTOR VEHICLE. Has the same meaning as set forth in I.C. 9-13-2-105. This definition shall, for the purpose of this chapter, mean a vehicle that is self-propelled, and shall include motorcycles and motorized bicycles that are self-propelled.
    RECREATIONAL VEHICLE. Has the meaning as set forth in I.C. 9-13-2-150. For the purpose of this chapter, the definition of RECREATIONAL VEHICLE shall not include vans.
    TRUCK. Has the meaning as set forth in I.C. 9-13-2-188.
    VAN. A motor vehicle that, in common usage, is referred to as a VAN. Included within this definition are motor vehicles commonly referred to as "converted vans," "mini-vans" and "passenger vans." This definition applies to all VANS, whether or not back seats are affixed.
