§ 73.57. DESIGNATION AND ESTABLISHMENT PROCEDURES.

  • (A) Whenever the owner, manager, tenant or occupant of any building being used or occupied for multi-family residences, or for business or commercial purposes desires to establish adjacent to the building designated emergency vehicle lanes, or the Fire Chief, after investigation determine that emergency vehicle lanes are vital and necessary for the protection of the building and the health and safety of persons therein, the Fire Chief shall inspect the location and determine the areas thereof to be designated as emergency vehicle lanes and notify the owner, manager, tenant or occupant of the building as to location thereof as well as the proper method of designating the location of signs to notify the public of the existence of the emergency vehicle lanes.
    (B) The owner, manager, tenant or occupant of the building must first request in writing to the Fire Chief his or her desire to establish emergency vehicle lanes at the building and an inspection for the purpose of determining the necessity, feasibility and location of lanes.
    (C) Following an inspection, the Fire Chief shall determine the need for emergency vehicle lanes and notify in writing the owner, manager, tenant or occupant of the building as to the proper location of the lanes.
    (D) The owner, manager or tenant of the building shall be responsible for having the curb (if one exists in the designated emergency vehicle lane area) painted yellow, along with the posting and maintenance of signs placed at or within the emergency vehicle lane area at least 5 feet high which indicate that the area is an emergency vehicle lane, the exact location of the lane and that the stopping or parking of a vehicle in that area is prohibited except for emergency vehicles.
    (E) The owner, manager, tenant or occupant of the building is responsible for requesting in writing to the Police Chief that the officers of the Police Department patrol the area of the building and the designated emergency vehicle lanes, and enforce the provisions of this subchapter pertaining to the prohibition of any nonemergency vehicle from stopping or parking in the lanes if the lanes are located on private property. The Police Department has no authority to enter on private property for purposes of enforcing this subchapter without this written permission of the owner, manager, tenant or occupant thereof.
